Legal Eviction Process and Procedures

Eviction Process

When a plaintiff is awarded an eviction, the presiding judge will set a date and time for the defendant to vacate the property.

If the defendant does not vacate by the ordered date and time, the plaintiff may call for assistance from the Sheriff's Office.

Important Notice

Evictions are a legal process that requires a court order. The Sheriff's Office enforces the court's eviction order only after all legal requirements have been met.

Sheriff's Role in Evictions

The DeKalb County Sheriff's Office assists in the eviction process only when authorized by a court order. Our role is to ensure the eviction is carried out peacefully and in accordance with Indiana law.

For Landlords (Plaintiffs)

  • You must have a court order for eviction
  • The tenant must be given proper notice
  • Call dispatch at 260-333-7911 if assistance is needed

Important: The sheriff's office will only enforce an eviction at the date and time specified on the eviction order. Any arrangements made between the landlord and tenant after the eviction order has been granted by the judge will void the eviction and render the sheriff's office unable to assist.

For Tenants (Defendants)

  • You have rights under Indiana law
  • You can contest an eviction in court
  • Follow court orders to avoid legal complications

Important Legal Information

For Landlords

Never attempt to forcibly remove a tenant without a court order. Self-help evictions are illegal in Indiana and can result in criminal charges and civil liability.

For Tenants

Ignoring an eviction order can result in law enforcement assistance being called. It is in your best interest to comply with court orders and seek legal counsel if needed.
